The Companies Act, 1956 is one of the governing laws for the registration of companies in India. The registration is made by the ministry of the corporate affairs by means of office of Registrar of Companies. The process of Company Registration begins with filling up an application available with the Registrar of companies. Thus when the name is allotted for a company, the documents regarding the company registration is filed with the respective ROC. In either one or two days, the company will get its registration and a certificate of incorporation will be issued to them.

The following are the steps involved under the Registration of companies. The first step is referred to as Pre-registration process. The following deals with the primary requirements to register a company. In case of a private company, there must be two directors and two share holders and in case of a public company, there should be three directors and seven share holders.

The second step deals with the availability of the name. The name of the company that is selected should be a peculiar one thro' out the country. The third step would be the documentation stage. Under this stage, the documents like

• Memorandum of association (MOA) and
• Articles of Association (AOA) are required to be submitted after the name of company is approved by the office of ROC.
