Post Not Delivered. How To File A Complain In Consumer Forum

Most of us in some point of time have suffered due to a delayed interview call letter, or a misplaced letter or more seriously a lost money order. People in such circumstances often want to take necessary actions against the Post Office for such negligence and want it to pay for the harassment also. But before approaching the Consumer Forum you must get yourself acquainted with the legal scope of your case.

What the law says

The Indian Post Office Act 1878 has laid down the guidelines for the working of the Post Office. Section 6 mentions that the government or the officers of the Post Office are not liable for loss or damage or mis-delivery of any article unless such liability is stated. If any article is lost or damaged or mis-delivered due to fraudulent or willful act of any employee of Post Office then the liability will rest with the Post Office.

What you can do?

Keeping this provision in mind, to get redressed through Consumer Forum for loss of money order or any letter is a remote possibility. Any person can approach the Consumer Court to claim the damages. But it will take minimum of 2 -3 years to get the verdict.
Huge number of cases is filed in consumer court every day. Even if the complainer wins, the maximum amount of reimbursement will be the amount of the money order. But the harassment and the headache of facing hearing in the court will surpass the reimbursement.
The best option would be to make a formal complaint against such negligence to the concerned authorities and demand necessary refund.
